Shopping regulations

§ 1
I. General provisions

1. These regulations define the rules for ordering and selling goods and services, including in particular:
– publications and museum souvenirs,
– making films produced by the Museum available online,
– making recorded museum lessons and workshops available online,
– providing online tours of museum exhibitions,
offered by the Museum of Nowy Sącz land, ul. Jagiellońska 56, 33 -300 Nowy Sącz, Cultural Institution entered into the Register of Cultural Institutions of the Małopolska Voivodeship Local Government under number 13/99, NIP: 734-11-38-068, REGON 000282122, via the website available at https:// museum.sacz.pl/sklep
2. The Store's offer is limited to the territory of the Republic of Poland.
3. The customer may be a natural person, a legal person or an organizational unit to which the Civil Code grants legal capacity.
4. A customer who is a natural person making purchases in the Store in an area not directly related to his or her business or professional activity is a "Consumer". Each time the Regulations refer to the Customer, it should also be understood as the Consumer.
5. By purchasing goods or services online, the Customer accepts the conditions set out in these Regulations.
6. The regulations are available in an electronic version on the store's website.
7. Correct use of the store is possible provided that the IT system used by the Customer meets the following minimum technical requirements:
– web browsers: Mozilla Firefox, Google Chrome, Internet Explorer 11.0, Safari,
– optimal screen resolution: 1152 x 768 px.

II. Online sales

1. The sales contract between the ordering Customer and the Seller, i.e. the Museum of Nowy Sącz land, is concluded if all of the following conditions are met:
– the Customer places an order online at https://muzeum.sacz.pl/sklep, which will include: the name of the product or service, the quantity of the ordered product/service, a completely completed data form in which you must enter: name, surname the ordering person, telephone number, e-mail address, delivery address if goods are ordered, address and invoice data if an invoice is to be issued to the Customer.
–the Customer pays for the order by bank transfer or payment card.
–the Customer receives confirmation of the transaction to the e-mail address provided by him.
2. The customer can purchase:
– without creating an account in the system,
– using the customer's created account.
3. Payment for the placed order should be made via:
– PayU system, before making a payment, check on the online booking pages whether the system supports the bank from which the payment transaction will be made or make a payment using a payment card accepted by the system,
– traditional bank transfer, prepayment to the account of the Museum of Nowy Sącz land no. 40 1500 1559 1215 5000 8864 0000 with precise information in the transfer on what account the prepayment is made.
4. All prices presented in the Store are expressed in Polish zloty, they are gross prices and include VAT. The price presented for a given product is binding for the Customer at the time of placing the order. Prices do not include delivery costs of goods. Information about delivery costs for a specific order will be available when placing it.
5. Pursuant to the Regulation of the Minister of Finance of December 28, 2018 on exemptions from the obligation to keep records using cash registers, the supply of goods or the provision of services to natural persons is not subject to fiscalization if the Seller has received the full payment to the bank account and from the records and documentary evidence payment clearly indicates what activity it concerned and to whose benefit the delivery/service is performed. Due to the above, a Customer who is a natural person does not receive a fiscal receipt.
6. If the Customer has marked an instruction to issue an invoice in the system, such an invoice will be sent via e-mail to the address indicated by the Customer.
7. A customer making a payment through a foreign bank should take into account the costs of bank intermediation, because only full payment guarantees the execution of the order by the Museum of Nowy Sącz land.
8. When purchasing goods/services online, payments are made via electronic transfer (PayU) or payment card.
9. Payments for tickets are handled by PayU Spółka Akcyjna with its registered office: ul. Grunwaldzka 182, 60-166 Poznań. The Museum of Nowy Sącz land is not responsible for any consequences resulting from irregularities in the operation of the payment system of the above-mentioned company.

III. Fulfillment of the customer's order

1. Orders are processed within the time specified below:
a) In the case of goods (publishings, souvenirs), from 2 to 5 business days counted from the date of crediting the payment of the order price along with delivery costs to the account of the Museum of Nowy Sącz land. This period does not include the time necessary for delivery. Ordered goods are shipped via a courier company or Poczta Polska. Information about the shipment of goods is provided to the Customer via e-mail or telephone.
b) In the case of online services (films, lessons and workshops, sightseeing, etc.) up to 3 business days counted from the date of posting the order price by the Customer to the account of the Museum of Nowy Sącz land. The purchased product made available online will be available to the Customer indefinitely or for a specified number of days. When purchasing a product, the date of its availability for the Customer will be determined each time.
2. To gain timely access to blocked film materials on the store's website, the Customer must provide his or her e-mail address in the film purchase window and accept the purchase regulations. After receiving the payment, the Customer receives access to the previously blocked content of the website with film materials or other online content. For the time specified during purchase, the Customer has access to the blocked website content by providing his or her email address in the video purchase window.
3. In the case of purchases of film content for an indefinite period, the Customer purchases access to the film using a previously created store Customer account. After receiving the payment, the customer receives a link to his/her e-mail address to download the film material to his/her computer.
4. Any doubts that the Customer has in connection with the order should be clarified by phone at 18 443-77-08 ext. 129 from Tuesday to Sunday from 10.00 a.m. to 4.00 p.m. or electronically via the e-mail address: sklep@muzeum.sacz.pl.
5. The customer does not have the right to copy, in whole or in part, the digital content provided as part of the service provided, or to distribute it in an unauthorized manner.
6. As part of the access to digital content, it is possible to play the material covered by this access only on one device at a time.

IV. Complaints

1. The Seller - Museum of Nowy Sącz land is obliged to provide the Customer with a product free from defects.
2. The Seller is liable to the Customer if the product sold has a physical or legal defect (warranty for defects).
3. In the case of a shipment of goods, upon receipt of the shipment by the Customer, he has the right to check the completeness of the contents of the shipment. If mechanical damage or incomplete content of the parcel is found, it is recommended to prepare a damage report in the presence of the courier or an employee of Poczta Polska, and send information about the situation to the indicated e-mail address. Preparing a report will speed up and facilitate the process of making a complaint about transport damage, but it is not a condition for successfully filing a complaint.
4. Complaints should be sent to the e-mail address of the Seller - Museum of Nowy Sącz land: sklep@muzeum.sacz.pl.
5. The complaint should include data enabling the Customer's identification, the subject of the complaint and requests related to the complaint. If the Seller receives an incomplete complaint, it will be requested to be supplemented, otherwise the complaint will not be considered. The Seller is obliged to consider the complaint within 14 days from the date of its receipt.
6. The cost of the complained return shipment is not charged to the Customer.

V. Withdrawal from the contract

1. A customer who has concluded a distance contract with the Seller - Museum of Nowy Sącz land has the right to withdraw from the contract without giving a reason within 14 days from the date of taking possession of the purchased items.
2. The Customer may withdraw from the contract by submitting a declaration of withdrawal to the Seller. The declaration can be submitted on the form, the template of which is attached as Annex 1 to the Regulations, by sending a scan after completing it to the e-mail address: sklep@muzeum.sacz.pl or postal address: Museum of Nowy Sącz land, ul. Jagiellońska 56, 33-300 Nowy Sącz. The Seller is obliged to immediately send the Customer confirmation of receipt of the declaration of withdrawal from the contract submitted in the manner referred to above to the e-mail address provided by him.
3. The Customer is not entitled to withdraw from a distance contract in relation to the contract:
a) for the provision of services, if the Seller has fully performed the service with the express consent of the consumer, who was informed before the commencement of the service that after the Seller has completed the service, he will lose the right to withdraw from the contract;
b) in which the subject of the service are items which, after delivery, due to their nature, are inseparably connected with other items;
c) when the subject of the service are sound or visual recordings or computer programs delivered in a sealed package, if the package was opened after delivery;
d) for the delivery of newspapers, periodicals or magazines, with the exception of subscription contracts;
e) for the provision of accommodation services other than for residential purposes, transport of goods, car rental, catering, services related to recreation, entertainment, sports or cultural events, if the contract specifies the day or period of service provision;
f) for the supply of digital content that is not recorded on a tangible medium, if the performance of the service began with the Customer's express consent before the deadline for withdrawal from the contract and after the Seller informed him about the loss of the right to withdraw from the contract.
7. In the event of withdrawal from the contract, the Customer is obliged to return the purchased goods to the following address: Museum of Nowy Sącz land, ul. Jagiellońska 56, 33-300 Nowy Sącz. The customer is obliged to return the goods immediately, but no later than 14 days from the date on which he withdrew from the contract.
8. The Seller - Museum of Nowy Sącz land will refund the amount paid immediately, and in any case no later than within 14 days from the date on which the Seller receives the declaration of withdrawal from the contract and the returned goods. The Seller will refund the payment using the same payment methods that were used by the Customer in the original transaction.
9. The goods returned by the customer should be packed in an appropriate way to ensure that the shipment is not damaged during transport. The customer is liable for any reduction in the value of the goods resulting from using them in a way that goes beyond what is necessary to establish their nature, characteristics and functioning of the goods.
10. If the Customer withdraws from the contract, the Seller will confirm the return of the goods by e-mail

VI. Final Provisions

1. The settlement of any disputes arising between the Seller - Museum of Nowy Sącz land and the Customer who is a Consumer shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Civil Code.
2. The settlement of any disputes arising between the Seller - Museum of Nowy Sącz land and a Customer who is not a Consumer will be submitted to the court having jurisdiction over the Seller's registered office.
3. In matters not regulated in these Regulations, the provisions of the Act of April 23, 1964, Civil Code, and the Act of May 30, 2014 shall apply. on consumer rights and other relevant provisions of Polish law.
4. The Customer who is a Consumer has the opportunity to use out-of-court methods of dealing with complaints and pursuing claims. Among other things, the Consumer has the opportunity to:
a) submitting a request to a permanent consumer arbitration court to resolve a dispute arising from the concluded Sales Agreement,
b) using the assistance of a district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection.
5. The consumer can find more detailed information on out-of-court methods of dealing with complaints and pursuing claims on the website http://www.uokik.gov.pl.
6. The consumer may also use the ODR platform, which is available at http://ec.europa.eu/consumers/odr. The platform is used to resolve disputes between consumers and entrepreneurs seeking out-of-court resolution of a dispute regarding contractual obligations arising from an online sales contract or contract for the provision of services.
7. The version of the Regulations in force on the date of placing the order by the Buyer applies to contracts concluded before the amendment to the Regulations.
8. The language of contracts concluded with the Store is Polish.
